These terms and conditions ("Terms") govern your access to and use of The Influencer List website at https://the-influencerlist.com (the "Site"), operated by The App Agency Ltd, a company registered in England and Wales ("we", "us", "our", "the Company").

By accessing or using the Site, you confirm that you accept these Terms and agree to comply with them. If you do not agree to these Terms, you must not use the Site.

We recommend that you print or save a copy of these Terms for your records. These Terms should be read alongside our Privacy Policy, which sets out how we collect and process your personal data.

4. Access to the Site

• Scrape, crawl, harvest, or systematically download content from the Site, whether by automated means or otherwise, without our prior written consent
• Access without authority, interfere with, damage, or disrupt any part of the Site, any equipment or network on which the Site is stored, any software used in the provision of the Site, or any equipment, network, or software owned or used by any third party
• Use any automated tool, bot, or script to submit handles or otherwise interact with the Site in a manner that could disrupt its normal operation
• Attempt to gain unauthorised access to the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site
• Attack the Site via a denial-of-service attack or a distributed denial-of-service attack

By breaching these provisions, you may commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

6. Creator directory and profiles

6.1 Nature of the directory

Our creator directory features publicly available information about social media influencers and creators. Profile information is compiled from publicly accessible sources and user submissions. The directory is provided for informational and editorial purposes.

6.2 Accuracy of information

We make reasonable efforts to ensure that the information displayed in our directory is accurate and up-to-date. However, we do not warrant or guarantee the accuracy, completeness, reliability, or timeliness of any profile information, including but not limited to follower counts, verification statuses, profile photographs, or niche categorisations.

Follower counts and other metrics are snapshots taken at the time of data retrieval and may not reflect real-time figures. Rankings and orderings are based on available data and do not constitute endorsements or qualitative assessments.

6.3 No endorsement or affiliation

The inclusion of any creator, influencer, or individual in our directory does not constitute an endorsement, recommendation, or affiliation with The Influencer List or The App Agency Ltd. We do not vet, verify, or vouch for any individuals listed in the directory.

6.4 Profile removal

If you are a creator or the authorised representative of a creator and wish to have a profile updated, corrected, or removed from our directory, please contact us at [email protected]. We will process removal requests within a reasonable timeframe.

7. Handle submissions

Our "Get Listed" feature allows visitors to submit Instagram handles for inclusion in our directory. By submitting a handle, you represent and warrant that:

• The handle belongs to you, or you have obtained explicit permission from the account owner to submit it for inclusion in our directory
• You understand that we will retrieve and display publicly available profile information associated with that handle, including the account name, profile photograph, follower count, and verification status
• The submission does not violate the rights of any third party, including intellectual property rights and privacy rights
• The submission is not made for the purpose of harassing, impersonating, or misrepresenting any individual

We reserve the right to refuse, remove, or modify any submitted profile at our sole discretion, without notice and without giving reasons. We are under no obligation to publish any submitted handle.

You acknowledge that submission of a handle does not guarantee immediate publication. Profiles are subject to our enrichment process, which retrieves publicly available data from Instagram, and may take time to complete.

8. Intellectual property rights

8.1 Our content

We are the owner or the licensee of all intellectual property rights in the Site, and in the material published on it, including but not limited to all articles, editorial content, design elements, logos, graphics, page layouts, and underlying source code. These works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may view, download, and print pages from the Site for your own personal, non-commercial use, subject to the restrictions set out in these Terms.

You must not:

• Modify the paper or digital copies of any materials you have printed or downloaded from the Site in any way
• Use any illustrations, photographs, video or audio sequences, or any graphics separately from any accompanying text
• Delete or alter any copyright, trade mark, or other proprietary notices from any materials printed or downloaded from the Site
• Reproduce, duplicate, copy, sell, resell, or otherwise exploit any part of the Site or its content for commercial purposes without our express written consent

8.2 Third-party content

Profile photographs and social media data displayed in our creator directory remain the intellectual property of their respective owners. "The Influencer List" and associated logos are trade marks of The App Agency Ltd. You may not use these trade marks without our prior written consent. All other trade marks, service marks, and logos appearing on the Site are the property of their respective owners.

9. User-generated content

Where you submit a handle or any other content to the Site, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, display, and publish that submission in connection with the operation of the Site and our directory services.

You retain ownership of any content you submit, but you acknowledge that we may continue to display publicly available information associated with a submitted handle for so long as the profile remains in our directory.

10. Third-party links

The Site may contain links to third-party websites, including but not limited to Instagram, other social media platforms, and external news sources. These links are provided for your convenience and information only.

We have no control over the contents of those sites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked from the Site, you do so entirely at your own risk and subject to the terms and conditions and privacy policies of those websites.

11. Disclaimers

The content on the Site is provided for general information purposes only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on the Site.

Although we make reasonable efforts to update the information on the Site, we make no representations, warranties, or guarantees, whether express or implied, that the content on the Site is accurate, complete, or up to date.

The Site is provided on an "as is" and "as available" basis. In particular, we will not be liable for:

• Loss of business opportunity, goodwill, or reputation
• Any indirect or consequential loss or damage

13. Indemnification

You agree to indemnify, defend, and hold harmless The App Agency Ltd, its directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the Site or any breach of these Terms
• Any handle you submit through the "Get Listed" feature
• Any claim that your submission infringes the rights of a third party
• Your violation of any applicable law or regulation

14. Suspension and termination

We may, at our sole discretion and without prior notice, suspend or terminate your access to all or any part of the Site for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Site will immediately cease. Any provisions of these Terms which by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability, and indemnification.

15. Severability

If any provision of these Terms is found by any court or competent authority to be invalid, unlawful, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the relevant provision shall be deemed deleted. Any modification or deletion of a provision under this clause shall not affect the validity and enforceability of the remaining provisions of these Terms.

16. Waiver

No failure or delay by us in exercising any right or remedy under these Terms shall operate as a waiver of that right or remedy, nor shall it prevent any future exercise or enforcement of that right or remedy. No single or partial exercise of any right or remedy under these Terms shall preclude or restrict the further exercise of that or any other right or remedy.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the Site. They supersede all prior agreements, understandings, and representations, whether written or oral, relating to such subject matter.

18. Governing law and jurisdiction

These Terms, their subject matter, and their formation (and any non-contractual disputes or claims) are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.

If you are a consumer resident in another part of the United Kingdom (Scotland or Northern Ireland), you may also bring proceedings in the courts of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on mandatory provisions of local law.
